What "DMCA-ignored" means here
Takedown rules differ from country to country. A notice sent under another country's law is a letter, not a court order. For servers in offshore locations, ClientVPS acts on orders from a court in the server's country, and on breaches of its Terms of Service, not on automated notices alone.
What it does not mean
- Not "anything goes": the uses listed in section 7 of the Terms are forbidden everywhere.
- Not true in every location: servers in the USA, the UK and the EU are under the law of those countries.
Not to be confused with
- DMCA
- The US Digital Millennium Copyright Act. Its takedown notices are a US legal procedure.
- Offshore location
- A location chosen for its legal environment, such as Moldova, Panama or Ukraine. See Locations.
Questions
Will my site be taken down after a DMCA notice?
A DMCA notice alone has no legal force where our offshore servers are located. ClientVPS acts on a court order from the server's country, and on breaches of its Terms of Service.
Does this apply to servers in the USA?
No. A server in the USA, the UK or the EU follows the law of that country.
